Terms of Service

1. Acceptance of Terms

By accessing or using PicPresto ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PicPresto is an AI-powered image generation platform that allows users to create images from text prompts using models from Google, OpenAI, fal.ai, and other providers. The Service is provided on an "as is" and "as available" basis.

3. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when creating your account.

4. Credits and Payments

The Service uses a credit-based system. Free accounts receive an initial allotment of credits. Additional credits can be purchased or obtained through a subscription plan.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.

All purchases are processed by Stripe. Refunds are handled on a case-by-case basis — contact us if you believe a charge was made in error.

5. Ownership of Generated Content

You own the images you generate using the Service and may use them for personal or commercial purposes, subject to the restrictions below and the terms of the underlying AI model providers.

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or abusive content
  • Create content that infringes on the intellectual property rights of others
  • Generate deceptive content intended to mislead (e.g. deepfakes for fraud)
  • Generate child sexual abuse material or non-consensual intimate imagery
  • Attempt to circumvent usage limits or abuse the credit system
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to access the Service without permission

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by PicPresto and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED IMAGES WILL MEET YOUR EXPECTATIONS. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES OR ARTIFACTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICPRESTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service will be resolved in the courts of competent jurisdiction.
